Advocate General Eleanor Sharpstone QC, the UK’s most senior member of the European Court of Justice has rightly and judiciously reminded the media of the ECJ’s possible role in article 50 and Brexit. She very properly also said the ECJ was conscious of the sensitivity and constitutional importance of the issue.
The issue is if a UK court referred a question to Europe on the interpretation of European law, eg whether article 50 can be revoked after it is triggered. That is then legally a matter for the European Court, because that is what the Treaties say.
Then again as Charles de Gaulle, a founder of the European project, once said : “Treaties at like rose…they last while they last”.
